What False Accusation and Rape Have in Common

Rape is a crime that has become a totem for many. Its invocation impoverishes all other violations of significance and accordingly authorizes violations that would not otherwise be tolerated, like lying about abuse to authorities and the courts. That rape occurs and that it’s an ineffably vicious act aren’t questions but facts. They are urgent facts, but their denial of other urgent facts is wrong. Those who zealously defend the criminal primacy of violence against women, to the exclusion of all other considerations, eagerly discover callousness in any who question the consequences of unchecked violence rhetoric, and the selfsame “advocates of sensitivity” dictate how victims of false accusation are “allowed” to feel.

These fish, caught in nets intended to trap shrimp, are called “bycatch.” For every shrimp that’s caught, there are as many as 20 casualties. The unintended victims are not released; they’re left to suffocate and rot (in the interest of economy).

There’s a reflex that’s triggered in a lot of people’s minds when you juxtapose the word rape with the phrase false accusation. The reason is basic.

Violence rhetoric has spawned laws that are like fishing nets: They snare anything that blunders into them, whether it’s what they were meant to catch or not. The intended and unintended targets of those laws are clubbed and gutted with the same zealous vigor and dispassion, and this conditions people who are railroaded through the system and stripped of everything on false, skewed, or exaggerated grounds to hate.

These people are predominately men, and they know they have decades of rampant violence rhetoric to thank for their loss of home, family, livelihood, and dignity. What’s more, civil complaints of legal abuses garner no attention except ridicule—and that, typically, from feminist quarters, which are also the source of the violence rhetoric that has engendered restraining order, domestic violence, family court, and child protection laws and policies that are billowy, careless, hyper-reactive, and easily exploited by the unscrupulous (and to dire effect).

This spurs aggressive counter-rhetoric, which is conveniently labeledmisogyny” and “rape denial,” particularly by the liberally biased, who accordingly react hysterically if rape and false accusation are compared. If you’re among those who decry “misogyny” and “rape denial,” look up the word etiology.

I’m not a misogynist, a rape-denier, or a liberal; I’m an analyst with no doctrinal loyalties. Rape and false accusation are not dissimilar, and I’ll tell you why.

  1. Most victims of false accusation, like most rape victims, are known to their attackers, often intimately; so the act of false accusation, like the act of rape, is a particularly treacherous and personal assault.
  2. Victims of false accusation, like victims of rape, are objectified; they’re denied their personhood and typecast according to a set of representations.
  3. The false accuser, like the rapist, is guided by the will to dominate and subjugate; his or her motive is control (as is the court’s).
  4. The falsely accused, like the rape victim, is denied his or her personal agency: S/he’s held down and forced to tolerate what’s inflicted upon him or her under threat of receiving worse.
  5. The falsely accused, like the rape victim, consequently suffers distrust, insecurity, and the mental trauma (PTSD) that comes of having it confirmed that s/he has no control over his or her circumstances.
  6. Like rapists, false accusers violate people because they can.
  7. Finally, like rape victims, the falsely accused enjoy no expectation of justice.

How false accusation and rape differ is that the false accuser uses a proxy terrorist (the awesome power of the state), his or her crime is public (with all the humiliation that implies), its toll may be extravagant (the victim may be left with nothing), and besides enjoying no expectation of justice, the falsely accused enjoys no expectation of recognition or sympathy, either (and may be harried relentlessly and then expunged).

*Yes, false accusation is bloodless (discounting suicides and the rare murder), but so, too, can what we call “rape” be bloodless. If the significant distinction between rape and false accusation is that victims of the former are predominately female and victims of the latter predominately male, then we’re overdue for a reevaluation of what we call “equality” and “equity,” both of which are feminist watchwords.

Women Are Bigmouths: Why This Has Been Bad for People Who’ve Been Abused by the Court…but COULD Be Good

I grudgingly constructed a page this week on Facebook, which confirmed to me two things I already knew: (1) I really hate Facebook, and (2) women are more socially networked than men.

Calling women “bigmouths” isn’t strictly right, and people affronted by the assertion will insist women and men talk about the same amount, or that men talk more than women do.

Uh-huh.

Not impolite to observe is that women “collaborate” more than men do, that is, they sooner work in tandem, which is what statistics I gleaned from Facebook corroborate.

“Tell us about the people you’d most like to connect with,” Facebook urges when you piece together a page on its site. My entries under “Interests” brought up terms like Men’s rights movement, Feminism, and Women’s rights. Accompanying these topics were figures about how many others had expressed an interest in connecting with people who shared those interests.

See for yourself.

Notice that 200 to 400 times greater interest in bonding with people concerned with women’s rights has been shown than interest in bonding with people concerned with men’s rights. That’s a lot…A LOT a lot.

I don’t think there’s anyone who would deny that the fruits of feminism owe to social networking. Some of these fruits have been great; some really horrible. This blog concerns the rotten ones: a culture of victimhood and false accusation combined with the legislation of accelerated and derelict legal procedures presided over by judges bigoted by politics, bad practices (including engineered social science), and money.

Men have been the majority of victims, and they’ve been the only source of concentrated complaint, concentrated complaint that’s been mocked and muted. If we can assume the 200 to 400 times greater interest shown in women’s rights translates more or less proportionally to the number of people disinterested in or opposed to men’s beefs, then no wonder. Female influence, which is significantly feminist influence, is vastly predominant. The sympathy market has been cornered.

Men aren’t the only victims of procedural abuse, however.

Many if not most of the victims who comment on this blog are women, and they’re often desolate. Some live like hermits, some like refugees. They feel exiled and isolated.

The irony is this is exactly how women felt before the rise of feminism, and there’s a lesson to be taken from that.

Men’s struggles for a market share of sympathy face a phalanx of resistance and the priority of conditioned sentiment (prejudice); they’re also troubled by men’s lesser inclination to work collaboratively (the maverick mentality is a losing one). Women, however, can work from behind the lines. They can tap into the women’s rights network and harness its power.

And they should.

A Circle of Moms Reports on False Allegations to CPS (and Says the Same Things That Father’s Groups Say about the Abuse of Restraining Orders and Domestic Violence Laws)

Here’s a group of women on a forum for mothers with school-aged kids responding to a conversational prompt that deserves the attention of those who believe false allegations made out of spite are rare and that the report of such allegations is overblown and only originates from father’s rights groups (or what one notable polemicist calls “FRGs”).

Has someone ever called CPS on you out of spite? Have you called on someone? Why?

Not surprising to this writer, a number of respondents commented in the affirmative. Also worthy of note in this context is that the site FightCPS.com is authored by a woman.

Here are a few of the topmost comments on the Circle of Moms thread:

Yes, twice I’ve had CPS called on me out of spite. Both times a social worker came to my house. I had nothing to hide, so I let them in and they both said, “I can’t tell you who called us, but I can tell you this is absolutely ludicrous for us to even come to your house, because we can’t find a single thing wrong. Sounds like a false allegation to me.” I was like, “I know, right. Thank you.” They couldn’t tell me who called, but I already knew who was behind it. The person who did it was just mad because I wouldn’t pay them money I didn’t even owe! This person was my babysitter, who is the most manipulative, money hungry witch. I just didn’t know it until now.

[M]y mom and sister have been calling and making false accusations about me ever since I told them they’re not my children’s mom—I am. They thought they were just going to tell me how to [rear my] kids, and I told them both, sorry about your luck, I’m their mom, and that’s final. I’ve never gotten a break from CPS since. Especially because my mom didn’t raise us—we did ourselves. And then she thought she was going to take mine and my husband’s first daughter and raise her as her [own] to try to fix mistakes that couldn’t be fixed. UH-UH, she wasn’t getting my daughter. Not till she called my sick, demented sister in to plot against me for 16 years and stole my life, my soul, my heart, my babies. Don’t trust no one.

The person [who] called them on me and my two children knew my mom was very sick and did not have much time to live. My mom died four days ago. Six days before she died, CPS came out. The person who called them on me wanted to add even more pain to my life—and fear. I went and picked up the report. It said [no] on every one of the allegations. I think CPS should let you know who called so you can file a lawsuit. I mean, if they do not do anything, then we should have a choice. We should have the right to know so we can stay away from those who called on us. It should be up to us to tell CPS to press charges or let us do it ourselves, and if we do not know who did call, then we have not got the right kind of privacy or peace throughout our lives.

According to a brochure published by the U.S. Department of Health and Human Services’ Children’s Bureau:

Approximately 29 States carry penalties in their civil child protection laws for any person who willfully or intentionally makes a report of child abuse or neglect that the reporter knows to be false. In New York, Ohio, Pennsylvania, and the Virgin Islands, making false reports of child maltreatment is made illegal in criminal sections of State code.

Nineteen states and the Virgin Islands classify false reporting as a misdemeanor or similar charge. In Florida, Illinois, Tennessee, and Texas, false reporting is a felony, while in Arkansas, Illinois, Indiana, Missouri, and Virginia, second or subsequent offenses are upgraded to felonies.

In Michigan, false reporting can be either a misdemeanor or a felony, depending on the seriousness of the alleged abuse in the report. No criminal penalties are imposed in California, Maine, Montana, Minnesota, and Nebraska; however, immunity from civil or criminal action that is provided to reporters of abuse or neglect is not extended to those who make a false report.

Eleven States and the Virgin Islands specify the penalties for making a false report. Upon conviction, the reporter can face jail terms ranging from 90 days to 5 years or fines ranging from $500 to $5,000. Florida imposes the most severe penalties: In addition to a court sentence of 5 years and $5,000, the Department of Children and Family Services may fine the reporter up to $10,000. In six States, the reporter may be civilly liable for any damages caused by the report.

Based on the anecdotal reports in the referenced Circle of Moms thread, consider how likely it is any of the reported mischief was ever prosecuted. This kind of sniping, which is impossible to fend off, exactly corresponds to that perpetrated by abusers of the restraining order process, which is also exempted from the exacting standards of police and judicial scrutiny that are supposed to be applied when allegations have criminal overtones or can lead to serious privations or criminal consequences.

The women responding in this forum aren’t “anti-feminists,” and they’re certainly not motivated to report malicious exploitation of state process because they’re “for” child abuse: They’re moms.

Yet despite that under the Violence Against Women Act (VAWA), billions of dollars have been invested over the past 20 years toward conditioning authorities and the courts to take allegations of violence and abuse on faith, when fathers allege identical exploitation of restraining orders and domestic violence laws according to the spiteful motives alleged by the mothers cited in this post, they’re dismissed as cranks by feminists and their partisans.

Disinterested parties and feminist sympathizers are urged to recognize that if mothers and fathers are saying the same things, then the claim that allegations of procedural abuses are nothing more than the baseless rants of angry men is flatly wrong.

“perjury and sociopaths”: On the Challenges of Contesting Restraining Orders Sought by the Mentally Aberrant, Deranged, or Ill

A recent respondent to this blog detailed his restraining order ordeal at the hands of a woman who he persuasively alleges is a sociopath. He says this label is generally scoffed at by people he explains the matter to and wonders how he could convince a judge of its accuracy.

Since this blog was published nearly two years ago, hundreds have been led to it by search terms that include words and phrases like “sociopath,” “mental illness,” “narcissist,” and “personality disorder” or “borderline personality disorder” (“bpd”).

This should hardly be a source of surprise.

Restraining order applicants aren’t screened based on their psychiatric histories. Sociopaths and narcissists, who are seldom clinically diagnosed in the first place, are moreover cunning liars and manipulators. Obtaining restraining orders—which are issued solely on the basis of brief interviews between petitioners and judges—is not only a simple matter for them but rewards their pathological drives for dominance and revenge.

Characterized generously, the restraining order process is fast-food justice. The ability and opportunity of most defendants to qualify allegations of sociopathy or insanity against their accusers—assuming these defendants even recognize these conditions—is effectively none at all. And unless a restraining order applicant is completely off the wall, his or her allegations won’t even cause a judge to arch an eyebrow. Applicants are in and out of restraining order interviews in a matter of minutes. Sociopaths are the smoothest liars you’ll ever meet, and the insane may be more convincing yet if they wholeheartedly believe their allegations in spite of those allegations’ possibly having no relationship to reality at all.

The imperceptibility of mental disorders is what makes them so difficult to expose (on this subject, see also these related posts).

I could go on about how easily the restraining order process is abused by sociopaths or the otherwise mentally aberrant. And I could describe to you the devastating effects their false allegations have on the lives of those they abuse.
